Terms of Service

Agreement

By downloading, installing, or using Packlist Pro, you agree to be bound by these Terms of Service. Please read them carefully before using the app.

1. Acceptance of Terms

By downloading, installing, or using Packlist Pro ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Eoncast ("we", "our", or "us").

2. Description of Service

Packlist Pro is a mobile application that helps users create and manage packing lists for travel and other purposes. The App provides:

  • Creation and management of custom packing lists
  • Pre-made templates for various trip types
  • Progress tracking for packed items
  • Sharing capabilities
  • Local data storage on your device

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal iOS device
  • Use the App for your personal, non-commercial purposes

This license does not include the right to:

  • Modify, adapt, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Copy, distribute, or publicly display the App

4. Free and Pro Versions

Free Version: The free version of Packlist Pro includes limited features:

  • Maximum of 2 custom lists
  • Maximum of 15 items per custom list
  • Full access to all 10 pre-made templates (unlimited items)
  • All other features including progress tracking, sharing, and dark mode

Pro Version: The Pro version, available as a one-time in-app purchase of $4.99 USD, unlocks:

  • Unlimited custom lists
  • Unlimited items per list
  • All future Pro features

The Pro upgrade is a one-time purchase and is non-refundable except as required by applicable law or Apple's refund policies.

5. In-App Purchases

All in-app purchases are processed by Apple through the App Store. By making a purchase, you agree to Apple's Terms and Conditions for the App Store.

  • Prices are displayed in your local currency
  • Payment will be charged to your Apple ID account
  • Purchases can be restored on other devices using the same Apple ID
  • Refund requests must be made through Apple

6. User Responsibilities

You are responsible for:

  • Maintaining the security of your device
  • Backing up your data (the App stores data locally on your device)
  • Using the App in compliance with all applicable laws and regulations
  • Any content you create or share using the App

7. Intellectual Property

The App, including its design, features, content, code, and documentation, is owned by Eoncast and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App or its content
  • Use our trademarks, logos, or branding without permission
  • Remove any copyright or proprietary notices from the App

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be error-free or uninterrupted
  • The App will meet your specific requirements
  • Any errors in the App will be corrected
  • The App will be compatible with all devices or iOS versions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

This includes, but is not limited to:

  • Loss of data
  • Loss of profits or revenue
  • Missed flights or travel disruptions
  • Forgotten items not on your packing list
  • Device damage or malfunction

Our total liability shall not exceed the amount you paid for the App (if any).

10. Data Loss Disclaimer

Since all data is stored locally on your device, we are not responsible for any data loss due to:

  • Device failure, damage, or loss
  • App deletion or reinstallation
  • iOS updates or device resets
  • User error
  • Any other cause

We strongly recommend regularly backing up your device through iCloud or iTunes.

11. Changes to the App

We reserve the right to:

  • Modify, update, or discontinue the App at any time
  • Add or remove features
  • Change pricing for future purchases

We will make reasonable efforts to notify users of significant changes through app updates.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Continued use of the App after changes constitutes acceptance of the new Terms.

We encourage you to review these Terms periodically.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, us, or third parties
  • Is fraudulent or illegal

Upon termination, your license to use the App will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the United States.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
